Calculating workers’ compensation in Louisiana

Louisiana’s workers’ compensation system does not take a one-size-fits-all approach to benefits. Not every work-related injury or illness is the same, so it makes sense that you should not have to meet the same standard of disability as every other injured worker to get approved.

Louisiana workers’ comp benefit types overview

In Louisiana, you can apply for one of four types of workers’ comp, based on the severity of disability you have and how long you expect the disability to last:

  • Permanent total disability
  • Permanent partial disability
  • Temporary total disability
  • Temporary partial disability

As these terms suggest, a permanent disability is one expected to last the rest of your life, such as an amputation or spinal cord injury. A temporary disability, on the other hand, might improve over time and allow you to return to work. A total disability means you are physically unable to do any job for pay, while a partial disability may allow you to do some jobs.

For both types of temporary disability and permanent total disability, once approved you will receive two-thirds of what your average wages were before your injury. As we’ve previously discussed, your compensation for a permanent partial disability is based on your specific loss. These are often amputation injuries.

You may also qualify for a one-time catastrophic injury payment of up to $50,000 if your injury is severe enough.

If you can work, but only at a job that pays less than 90% of your old job, you can receive supplemental earning benefits equal to two-thirds of the difference between your old average monthly income and your current monthly average. Those benefits only last up to 10 years, however.
