Medical care under Louisiana workers’ comp law

| Apr 19, 2016 | Workers' Compensation |

One of the things many clients want to know when they contact my firm is what sort of medical care they can expect to receive if they are injured while on the job. They want to know if they will be able to see their own doctor or if they have to go to someone that has been pre-selected by their employer or employers’ insurer.

This post discusses some of the basic information regarding medical care for injured workers. We wanted to provide you with a brief overview of what you can expect if you find yourself injured in a workplace accident.

The workers’ compensation code in Louisiana allows workers the ability to see their own physician for treatment of their injuries. However, there are provisions that require workers to get approval from their employer if the costs associated with the care are above certain thresholds. This can quickly become complicated if you do not know and understand your rights under the law.

In many cases, it will take a great deal of time for your injuries to heal correctly. This may mean consulting specialists or receiving second opinions in order to get the right treatment plan in place for you.

Unfortunately, many insurance companies want to see the injured workers back on the job as soon as possible. They may not agree with the treatment plan that your physician has prescribed, and might make it difficult for you to get the compensation you need to pay these expenses.

Louisiana workers’ compensation laws also allow injured workers to request an independent medical examination. This means that you will be evaluated by a physician who is not currently involved in your case to determine what the next steps should be in your treatment plan.

It is likely that you will still have questions about how these laws will apply to your case. You should contact an experienced workers’ compensation attorney to determine the type of benefits that are available to you in your specific situation.

Your attorney will be able to review your injuries, and help you find the right care that allows you to return to health. Once you have a clear view of your rights under the law, you will be able to make the best decisions for your future. An attorney will help you protect yourself from being forced back to work before you are healthy.
