The Most Important Decision You Will Make - Choosing a Doctor

When it comes to workers' compensation claims, there are doctors who work mostly for insurance companies and there are those who choose to treat injured workers.  Under Louisiana law, an injured worker is entitled to a physician of his own choosing in any specialty he or she requires.  For most work-injuries, that will be an orthopedist or neurologist.  The insurance company is then entitled to have you see a doctor of their choosing in the same field of specialty.  Your choice of physician is your treating physician and the insurance company's doctor is considered a Second Medical Opinion (SMO), but not the doctor you go to for treatment.  Unfortunately, you will not know whether the doctor you choose works mostly for insurance companies or is someone chosen more often by injured workers.  You will find out, however, when he or she releases you to return to work and you're still in pain.  It is only then that you will realize that your doctor is putting the insurance company's interest over yours because insurance companies are his or her "bread and butter" and its how he or she can afford the big house, nice car, boat, etc..  And, once you choose a doctor, it is virtually impossible to change doctors.  So, don't make the mistake of choosing the wrong doctor.  CALL ME AS SOON AS YOU CAN - BEFORE YOU CHOOSE A DOCTOR.  DON'T LET THE EMERGENCY ROOM STAFF OR WALK-IN CLINIC STAFF TELL YOU WHO YOU SHOULD CHOOSE AS YOUR DOCTOR!!

What I Charge!

Many workers' compensation lawyers in Louisiana will not only charge a percentage of any settlement, but also a percentage of any weekly workers' compensation check you receive while not working after your accident.  If you are entitled to receive a weekly workers' compensation check, that check will be for 2/3rds of your average weekly wage (AWW) at the time of your work accident.  For many people, that is not a lot of money and having to pay their lawyer a percentage of what they receive only adds to their troubles during what is very likely a difficult and trying time.  Therefore, I do not collect any part of my clients' weekly workers' compensation checks.  I charge only 20% of whatever may be gained in settlement, plus any cost I incure, assuming you reach maximum medical improvement (MMI) and are in a position to settle your claim.  If your claim proceeds to trial, the Office of Workers' Compensation judge will award attorney's fees to be paid by your employer and their workers' compensation insurer.
